Course overview

Water law is a primary means by which water policy objectives can be achieved. It is important for those involved with any aspect of the water sector to be aware of and understand the prevailing legislation. It is equally important to also understand how and why it developed, and whether it is having the desired impact. The legislation relating to water is diverse, complex and sometimes uncoordinated. This unit will explain not only the law in theory but also the law in practice. It will also explore the behaviour of the regulators and the regulated.

Course description

Basic principles of law and relationship to policy and policy objectives

Introduction, UK statutes and cases, sources of law, international treaties,  EU Directives; Divisions of law - civil/criminal, public/private etc;  English legal system, courts, common law;  Environmental regulatory agencies and public inquiries;  political philosophy and public perceptions (needs and demands).

Water law

  • Water law: Water resource management – conservation, control, allocation
  • Water resource protection – quality objectives, pollution control
  • Water supply and waste water disposal – rights and obligations
  • Water environment protection – habitats (wetlands), flooding, drainage
  • Water rights and rights to water.

On successful completion of this module the delegate will be able to:

1. Discuss the purpose and sources of water law.
2. Explain how the English, EU and international legal system works with respect to water law.
3. Describe the key elements and purpose, and critically comment on the effectiveness, of the various laws relating to the full range of water management issues: such as resource allocation, quality management, pollution control, flood control & drainage.
4. Discuss the relationship between society and water law.
5. Comment on the likely legal implications of specified water cases or scenarios.
